The Finnish Market Court has on 12 October 2007 issued a decision to
dismiss without considering the merits the petition filed by Citycon
Oyj and Skanska Talonrakennus Oy on 27 April 2006 in the tender
procedure regarding the construction of a shopping centre and related
areas in Ratina region in the City of Tampere, Finland.

According to the Market Court, the main purpose of the contractual
arrangement regarding the implementation of the project described
above has been to sell the properties identified by the City to the
selected party so that this would construct and hold a title to a
shopping centre in said area. According to the decision of the Market
Court, this project is not procurement as defined in the Public
Procurement Act, since the Public Procurement Act is not applicable
to the main part of the entire contractual relationship and the
Market Court is thus not competent, under the Public Procurement Act,
to take up the petition.

The City Board of Tampere has already earlier dismissed the claim for
reversal filed by Citycon Oyj and Skanska Talonrakennus Oy on 27
April 2006.
